WhisperBoard Terms of Service
These Terms of Service ("Terms") are an agreement between you and Pribadi Tech governing your use of the Service. Please read them carefully before using the Service. By downloading, installing, or using the app you agree to these Terms. If you do not agree, please do not use the app.
WhisperBoard is independently developed and operated by Pribadi Tech. Our Privacy Policy explains how we collect, use, disclose, and retain personal information in connection with the Service. Please review it before using WhisperBoard. It is available at https://whisperboard.pribadi.tech/privacy-policy.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country to use this kind of service) to use the app. If you are old enough to use the app but not old enough to enter a contract where you live, you confirm that a parent or guardian agrees to these Terms on your behalf. If you are under the minimum age, do not use the app.
2. The service we provide
WhisperBoard is a voice keyboard: you speak, and your words become typed text. The app can work in two ways, and which one you use is your choice:
- Bring your own key (BYOK) or self-hosted server. You configure the app to send your audio to a speech-to-text service you choose, using your own account or server. No WhisperBoard account is needed.
- WhisperBoard Services. You sign in with Google and your audio is processed by the WhisperBoard service, which works with third-party providers to turn your speech into text. This mode supports the free tier, paid plans, credit packs, and referral rewards.
We may change, suspend, or discontinue any part of the app from time to time, and we may introduce new features or retire old ones. We will try to give you reasonable notice of changes that materially affect you, where it is practical to do so.
3. Your account
An account is only needed for WhisperBoard Services mode. To create one you sign in with Google; we do not receive your Google password. You are responsible for maintaining the security of your account and for activity performed through it that is reasonably within your control. Notify us promptly at pribadi.technology@gmail.com if you suspect unauthorized access.
You may delete your account at any time by following the process described in our Privacy Policy.
4. Bring-your-own-key and self-hosted use
If you use BYOK or self-hosted mode, the relationship is between you and the provider or server you choose:
- You are responsible for your own API key, endpoint, account, and any costs charged by your provider.
- Your provider's terms of service and privacy policy govern that part of your use, and we are not a party to it.
- WhisperBoard's servers are not involved and we do not receive your audio or your transcripts in this mode. We cannot help with billing or support issues that belong to your provider.
- Do not store your API key anywhere that could expose it to others, and do not share keys that your provider's terms say you must keep private.
5. Paid plans, credits, and subscriptions
Paid features in WhisperBoard Services mode are purchased through Google Play. Purchases and subscriptions are processed through Google Play, and you can manage or cancel subscriptions through your Google Play account. Refund requests are handled according to Google Play's policies and applicable law.
- When you buy a subscription, it renews automatically until you cancel it in Google Play. Cancelling stops future billing; depending on Google's rules and local law you may keep access until the end of the period you paid for. Cancellation does not normally issue a retroactive refund for time already billed.
- Each plan or credit pack includes the features and usage allowance displayed in the app at the time of purchase. Actual transcription results and availability may be affected by service interruptions and third-party provider availability.
- Credit balances are not money, have no cash value, and cannot be exchanged for cash or transferred to another account.
- Plans, prices, and allowances may change over time. If you are on a paid plan, we aim to give you reasonable notice before a change that makes your plan less generous, so you can decide whether to continue.
- Uninstalling the app or deleting your WhisperBoard account does not automatically cancel an active Google Play subscription. You must cancel it through Google Play to stop future renewals.
How your credits work
WhisperBoard keeps two kinds of transcription credit, and they are always used in a fixed order.
Monthly allowance (paid plans). A paid plan includes a monthly allowance of transcription time.
- The monthly allowance is used first, before any other credits.
- It refreshes monthly, anchored to your subscription's event date (the date your subscription started or renewed), not the calendar month.
- Unused monthly allowance expires when it refreshes. It does not roll over.
Credit grants (vouchers, referral rewards, and one-time top-ups). Vouchers, referral rewards, and one-time top-up purchases each create a separate credit grant.
- Each grant has its own expiration date, or has no expiration.
- Referral credits always expire. Voucher and top-up credits may expire or may have no expiration.
- After your monthly allowance is used up, grants are consumed by earliest expiration date, regardless of whether they came from a voucher, a referral reward, or a top-up purchase.
- Grants with no expiration date are consumed last.
- If two grants share the same expiration date, or neither expires, the grant added first is consumed first.
Where expiration dates are shown. The expiration that applies to a paid top-up is shown before you buy it. The expiration that applies to a voucher or referral credit is shown when it is offered or issued. If a credit does not expire, it will be identified as having no expiration.
6. Acceptable use
You agree not to misuse the app or the WhisperBoard service. Specifically, you will not:
- use the service to violate any law or regulation;
- attempt to circumvent quota limits, abuse the free tier, or defraud the referral or voucher programs (for example by creating fake accounts, using the same device to redeem repeatedly, or otherwise gaming the system);
- resell, redistribute, or provide access to the service to others as a paid offering;
- interfere with or disrupt the service, its servers, or connected networks;
- attempt to gain unauthorized access to any part of the service, other accounts, or computer systems; or
- reverse engineer, decompile, or disassemble the app, except to the limited extent the law allows.
We may suspend or terminate accounts that violate these rules, as described in Section 12.
7. Your content
You own what you dictate. The transcribed text you produce belongs to you, and you are responsible for the content you dictate, including making sure you have the right to record and process it.
To provide the features you request, you give us a limited, non-exclusive permission to transmit and process your audio and transcript only as necessary to provide those features, operate and secure the Service, and comply with applicable law. This permission ends when the relevant processing is complete, except where retention is described in our Privacy Policy. It is a permission to process your content, not a claim of ownership.
In BYOK mode, you instruct the app to transmit content directly to the provider you configure, and we do not receive it.
We do not claim ownership of your audio or transcripts. We do not sell them, and WhisperBoard does not use them to train its own AI models. Providers you choose may process information under their own terms, particularly in BYOK mode. When you use WhisperBoard Services, your audio is processed and then discarded as described in our Privacy Policy.
8. The app and our intellectual property
The WhisperBoard app, including its code, design, name, and branding, is the property of Pribadi Tech and is not open source. All rights are reserved. We grant you a limited, non-exclusive, non-transferable license to use the app on devices you own or control, for your personal or internal business purposes, subject to these Terms. This license does not give you ownership of the app, and you may not copy, modify, distribute, sell, resell, sub-license, or create derivative works from the app, or provide it to others as a service or paid offering, except to the limited extent the law allows.
Certain components included in the app may be provided under separate open-source or third-party licenses. Those licenses govern those components where they apply.
"WhisperBoard" and related names and logos are used to identify the app. Nothing in these Terms grants you a right to use our name, logo, or branding.
9. Third-party services
The app relies on third-party services, including Google (sign-in, Crashlytics, and Google Play) and, in WhisperBoard Services mode, speech-to-text and translation providers. Your use of those services is also subject to their own terms and privacy policies. We are not responsible for the actions or failures of these third parties, but we choose them with care and expect them to meet reasonable standards of privacy and reliability.
10. Disclaimers and no warranty
The app is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In particular, and to the fullest extent permitted by law:
- We do not warrant that transcription or translation will be complete, accurate, or error-free. Speech recognition is imperfect and can make mistakes, especially with unusual words, names, accents, background noise, or poor audio quality. Review important transcription and translation results before relying on or sending them.
- WhisperBoard is not designed for emergency communications or as the sole method for creating or transmitting medical, legal, financial, safety-critical, or other high-risk information.
- No online service can be guaranteed to be completely secure, uninterrupted, or error-free, and we cannot promise that every defect will be corrected.
- Any audio or text you process through a provider you configure yourself is processed under that provider's terms, at your own risk.
11. Limitation of liability
To the maximum extent permitted by applicable law, Pribadi Tech and its personnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the app or service, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total liability to you for all claims arising out of or relating to the app or these Terms shall not exceed the greater of (a) the amount you actually paid us in the twelve months preceding the claim, or (b) the equivalent of ten United States dollars (USD 10).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or fraud.
Before starting formal proceedings relating to these Terms or the app, we ask that you contact us at pribadi.technology@gmail.com and provide a reasonable opportunity to investigate and attempt to resolve the dispute informally. This does not prevent either party from seeking urgent relief or exercising rights that cannot legally be restricted.
12. Termination
You may stop using the app at any time by uninstalling it. Where you have an account, you may delete it as described in our Privacy Policy. Uninstalling the app or deleting your account does not automatically cancel a subscription managed through Google Play; you must cancel it through Google Play to stop future renewals.
We may suspend or terminate your access to the app or account if you materially breach these Terms (for example, by abusing the referral or voucher programs or misusing the service). Where reasonably possible, we will provide notice and an opportunity to correct the violation before terminating. We may act immediately where necessary to prevent fraud, abuse, security risks, harm to others, or legal violations.
If we suspend or terminate an account for a material violation, access to managed features and credits may be restricted while the matter is addressed. Any refund or continued subscription access is determined under Google Play's policies and applicable law, and termination does not automatically cancel a subscription managed through Google Play. On termination your rights to use the app end, and Sections 7, 8, 10, 11, and 14 survive.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page and revise the effective date at the top. Where appropriate or required, we may also provide notice through the app or by email. If you continue to use the app after a change takes effect, you accept the updated Terms. If you do not agree, you should stop using the app.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Indonesia, the country where the developer of WhisperBoard lives and operates.
If a dispute is not resolved through the informal process described in Section 11, it will be decided in the competent courts of Indonesia.
Nothing in these Terms takes away any rights you have under the law of the country where you live that cannot be waived, including consumer-protection rights. If the law of your country gives you the right to bring a dispute in your own local courts, that right is not affected by this section.
15. Severability and entire agreement
If any part of these Terms is found to be unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of the Terms remain in effect. These Terms are the entire agreement between you and us regarding the app and supersede any prior agreements.
16. Contact
If you have any question about these Terms, or a problem with the app, contact us at pribadi.technology@gmail.com.
